Spanish Government approved the Royal Decree on "Influencers"

On 1 May 2024 the Royal Decree regulating the status of "Influencers" entered into force in Spain. 


The Decree establishes the requirements based on which a content creator (influencer) becomes considered as "user of special relevance": 


1. Income - Content creator with income of more than 300 000 euros per year derived from its activity; 


2. Number of followers - Content creator who has 1 million followers on one video platform, or 2 million on different video platforms; 


3. Number of videos - Content creator who publishes at least 24 videos per year.


All content creators who meet these three criteria must register, within two months, in the State Registry of Audiovisual Providers as a "user of special relevance". 


"Users of special relevance" should comply with the following rules derived from Law 13/2022, of July 7, General of Audiovisual Communication:


🎁 Identification of advertising content.


🚬 Prohibition of tobacco advertising. 


🥃 Regulation of alcohol and gambling advertising (with some exceptions, for example, any product that exceeds 20 degrees can only be promoted between 01:00 and 05:00 in the morning); 


🔞 Protection of minors. 


Thus, taking into consideration the role of influencers in the modern advertising landscape, one more European country has adopted specific regulations to protect consumers' interests.
